Netflix and Tivo?

Newsweek's reporting that Netflix and Tivo are on the verge of partnering to provide downloads of movies to Internet connected Tivo machines from Netflix's library of films. The article is light on details but has this quote from Netflix CEO Reed Hastings on his company's long term plans: "We named the company Netflix, we didn't name it DVD by Mail."

I have to wonder how this is legal if they don't have permission from each film's rights holders. I'm no lawyer but I'm pretty sure owning a copy of a DVD doesn't give you the right to re-encode the video and transfer it to another device where it could stay for a possibly indefinite period of time.

Then there's the issue of the download time. Call me old fashioned but I'd rather wait a day for a disk to show up in the mail than many hours for it to show up on my tivo. Not that I think this is a bad idea. HBO On Demand (HBO & Time-Warner Cable's way of storing HBO shows and movies on your cable box DVR for anytime viewing) has saved me from boredom-induced suicide on at least one occasion. I just see many potential problems in the beginning for Netflix and Tivo.
