I reached out to a YouTube spokesperson for a comment on that troublesome situation with Kevin Lee's critical video essays. Here's their official statement:
We do not comment on individual videos. The YouTube community is free to post content on the site – including videos, comments and ratings. We take copyright issues very seriously and prohibit users from uploading infringing material. We cooperate with copyright holders to identify and promptly remove infringing content from the site. Our community guidelines make it clear that users must own or have permission from the copyright holders to post any videos. When we receive a DMCA take-down notice alleging a video infringes copyright, we disable the video and notify the user who uploaded the video. The user then has an opportunity to challenge the complaint.
